In Scotland, it's now a legal requirement to have a licence if you’re operating a short-term let.

As the host, you're the one responsible for the agreement between your guests and the property – even if you’ve got someone else managing it on your behalf day-to-day.

If you’re not the owner of the property, you’ll need written permission from the owner(s) before applying for a licence.

If you started operating before 1 October 2022, you must have submitted your licence application by 1 October 2023 to continue legally. If you're a new host, you must apply and be approved before taking any bookings.

Make sure to check whether your local council requires planning permission before applying – this is especially relevant for secondary lets.

Post-Approval Support: Once your licence is granted, we can help you keep on top of renewal deadlines and ensure ongoing compliance.

SHORT-TERM RENTAL LICENSES BEEN INTRODUCED?

Short-term lets have played a big part in Scotland’s tourism industry, offering travellers more flexible and affordable options while benefiting local economies. To maintain safety and quality, the Scottish Government introduced a licensing scheme to ensure all short-term rentals meet key standards. It also gives local councils more control to address specific concerns within their communities – helping create a safer, more reliable experience for guests and neighbours alike.

NEW LEGISLATION FOR
SHORT-TERM RENTALS

Yes, this is something to be mindful of. It’s mandatory to display a notice (for at least 21 days) in the close vicinity of your property, informing neighbours of your licence application. We’re currently preparing a notice template to make this easier for you, and we’ll also assist with the distribution process. If you choose to make your own, we strongly recommend using a friendly and approachable tone.

Objections can be submitted by neighbours or any individual who wishes to raise concerns. One of the core aims of this licensing scheme is to promote safety and address neighbour-related issues. Grounds for objection may include:

  • The application doesn’t align with the licensing authority’s policy on overprovision

  • The application contains inaccurate or misleading information

  • Concerns over the safety of guests, neighbours, or others

  • Noise complaints or nuisance concerns

  • Conflicts with other legal or contractual agreements

You’ll have the opportunity to respond to any objections raised. It’s important to provide honest and accurate information in your application to strengthen your position.
